  1. Concerned about our customers, we pay particular attention to the care of your privacy and your data. We want you to feel comfortable while using our services.
  2. Therefore, below we present you with the most important information about the principles of processing your personal data by us and the cookies that are used by our Shop. This information has been prepared in consideration of GDPR, the General Data Protection Regulation.

How we will use your data

  1. When making a purchase in our shop, using our services or creating a user account, you will be asked for your personal data. The data you will be requested to provide will be processed for the purposes indicated below, related to the functioning of the Shop and the provision of the services offered therein (“Services”).
  2. As the controller of your data, we are particularly careful to ensure adequate protection and proper processing:
    • the data are processed lawfully and in a transparent manner for the data subject;
    • the data shall be collected for specified and clearly defined purposes and processed only in that manner;
    • the data are collected only to the extent necessary to fulfil the specified purpose;
    • the data which are processed shall be subject to suitable safeguards to protect them against unauthorised or unlawful processing and against damage or destruction.

Purpose of the processing:

  1. The purpose and scope of the processing of your data will depend on your consent or the law in each instance.
  2. The possible purposes for which we will process your data are:
    • Provision of services offered in the Shop
    • Fulfilment of your orders
    • Direct marketing of the services offered, other than the newsletter
    • Sending the newsletter
    • Transfer of data to online payment operators
    • Transfer of your personal data to ING Bank Śląski S.A. (“Bank”) in connection with:
      1. provision by the Bank to the Online Shop of the service of making available the infrastructure for processing payments via the Internet (legal basis: Article 6(1)(f) of the Regulation).
      2. processing and settlement by the Bank of payments made by customers of the Online Shop via the Internet using payment instruments (legal basis: Article 6(1)(f) of the Regulation).
      3. in order for the Bank to verify the proper performance of the agreements concluded with the Online Shop, in particular to ensure the protection of the payers' interests in connection with the complaints submitted by them (legal basis: Article 6(1)(f) of the Regulation).
    • the transfer of your personal data to Twisto Polska Sp. z o.o. in connection with the possibility of Twisto Polska Sp. z o.o. offering to make payment for goods or services purchased by Twisto Polska Sp. z o.o. under an agreement of mandate including a purchasing formula “Buy with Twisto” and making this purchasing formula available through the Online Shop, and also for the purpose of Twisto Polska Sp. z o.o. verifying the proper execution of such agreements of mandate (legal basis: art. 6, sec. 1, letter f) of the Regulation).
  3. Depending on the purpose, the data we will process is:
    • The data provided when placing an order is necessary for its execution - in particular, name and surname, address of residence and delivery address, if different (street, house number, flat number, postal code, city), telephone number, e-mail address, for companies additionally company name, Tax Identification Number.
    • The data provided when using the contact form, making a complaint or sending an e-mail enquiry
    • The data related to previous purchases in our shop, purchased products.
    • The data necessary to process online payments, instalment and deferred payments and to verify the correctness of the transactions made.

Processing basis:

  1. First and foremost, the basis for data processing is the need to perform the sales agreement, create an account in the shop or prepare an offer (Article 6(1)(b) GDPR - The Sales Agreement or actions undertaken at your request in order to conclude it). This refers to the data you provide when placing an order, creating an account in the shop or submitting an enquiry.
  2. The data will also be processed for the performance of our legal obligations, e.g. in connection with accounting (Article 6(1)(c) GDPR) and for the establishment, investigation or defence of possible claims (Article 6(1)(f) GDPR).
  3. In the event of data relating to newsletter subscriptions, the data will only be processed on the basis of your consent expressed in the shop (Art. 6(1)(a) GDPR). You can withdraw this consent at any time. Just send an email to [email protected] with information about unsubscribing from the newsletter.
  4. For other purposes, your data may be processed on the basis of:
    • Our legitimate interest in conducting direct marketing (Article 6(1)(f) of the GDPR)
    • Our legitimate interest in processing data for analytical and statistical purposes (Article 6(1)(f) GDPR)
    • Our legitimate interest to survey customer satisfaction (Article 6(1)(f) of the GDPR)
    • Our legitimate interest in billing and verifying the correctness of payments made by customers of the Online Shop via the Internet using payment instruments (Article 6(1)(f) GDPR)
    • Our legitimate interest in using the infrastructure provided to us to process payments online (Article 6(1)(f) GDPR)

Obligation to provide the data and consequences of failure to comply

  1. Providing personal data in the shop is voluntary, however it is necessary in order to use the shop's services, for example placing and processing an order, registering an account or preparing an offer.
  2. Each time, the scope of the data required is specified in the shop by means of relevant communications, by way of communication with you or in the Terms and Conditions. The data we specify is only that which is necessary to process the order/service.
  3. If you do not provide the data indicated, we may not be able to perform a certain action effectively, in particular:
    • inability to register in the Shop
    • inability to use the Shop's services
    • inability to make purchases in the Shop
    • inability to make payments via Internet payments, including quick online payments, instalment payments, deferred payments (Twisto)
    • inability to receive information about promotions or special offers offered in the Shop
  4. If you provide your personal data in order to conclude the agreement with the Online Shop, providing your personal data is a condition for concluding this agreement. Providing personal data in this situation is voluntary, however, the consequence of failing to provide such data shall be the impossibility to conclude the agreement with the Online Shop.
  5. In the event that you provide your personal data in order to transfer them to Twisto Polska sp. z o.o. before concluding the Sales Agreement of goods (or services) purchased in the Online Shop, the transfer of those data is the condition of concluding the Sales Agreement in connection with the business model adopted by the Online Shop.
  6. In the event that your personal data is provided to the Bank in connection with the processing and settlement of payments made by you to the Online Shop via the Internet using payment instruments, the provision of data is required in order to process the payment and provide the Bank with a confirmation of its completion to the Online Shop.
  7. In the event that your personal data is provided to the Bank in order for the Bank to verify the proper performance of the agreements concluded with the Online Shop, in particular to ensure the protection of the interests of the payers in connection with their complaints, the provision of such data is required in order to enable the performance of the agreement concluded between the Online Shop and the Bank.
  8. In the event of transferring your personal data to Twisto Polska sp. z o.o. in connection with the possibility of Twisto Polska sp. z o.o. offering you to pay the price for the goods or services purchased by you, within the framework of a contract of mandate including the purchase formula “Buy with Twisto” and making this formula available by the Online Shop, providing these data and processing them for this purpose is required in connection with the business model adopted by the Online Shop and for the execution of the contract concluded between the Online Shop and Twisto Polska Sp. z o.o.

Profiling

  1. Our shop does not conduct automated profiling of the shop's offer involving the automated presentation of specific products, discounts or promotions.

Possibility of withdrawing consent:

  1. Remember that you have the right to withdraw your consent regarding the processing of your data at any time.
  2. Processing remains lawful until you withdraw your consent.

How long we will process your data

  1. We will only process your data for as long as we have a legal basis for doing this, which is:
    • we are no longer under a legal obligation to process your data
    • the possibility of establishing, investigating or defending possible claims related to the agreement concluded by the Shop by the parties will cease
    • you will withdraw your consent to the processing of data where it was based
    • your objection to the processing of your personal data is accepted, where the processing was based on a legitimate interest of the controller or where the data were processed for direct marketing purposes
  2. - whichever is applicable in the particular instance and which occurs last.

Security of your data

  1. When processing your personal data, we apply organisational and technical measures in accordance with the relevant legislation, including the use of encryption of the connection using an SSL certificate.

Your rights

  1. You have the right to request at any time:
    • access to your personal data,
    • their rectification,
    • deletions,
    • restriction of processing,
    • request the data to be transferred to another controller,
  2. And also:
    • object at any time to the processing of your data:
      • on grounds relating to your particular situation - against the processing of personal data concerning you based on Article 6(1)(f) of the GDPR (i.e. on legitimate interests pursued by the controller),
      • where personal data are processed for the purposes of direct marketing, to the extent that the processing is related to such direct marketing.

  4. If you consider that your data is being processed unlawfully, you can submit a complaint to the supervisory authority.

To whom we may share your data

  1. Depending on the extent to which you use the shop, we may transfer your data to different recipients, whereby this group also depends on the consents given, legal provisions or shop activities undertaken.
  2. To a different and limited extent, the data processing process may involve hosting or ICT service providers, agents and carriers delivering the orders (e.g. Poczta Polska, Fedex), entities operating electronic payments in the shop (e.g. PayU, ING Bank Śląski S.A., Twisto Polska sp. z o.o.), providers of legal and accounting services, providers of analytical tools or those supporting us in marketing campaigns.

  1. Our Shop, like most websites, uses so-called cookies.
